NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  SWEEPSTAKES BEGINS AT 12:00:00 AM ET ON OCTOBER 9TH, 2009 AND ENDS AT 11:59:59 PM ET ON November 9th, 2009. VOID WHERE PROHIBITED.

• HOW TO ENTER:  You may enter The Balancing Act Navigate Your Career Sweepstakes (“Sweepstakes”) by completing the official entry form (“Entry”) available at www.thebalancingact.com (the “Contest Sites”), indicating your acceptance of these Official Rules, and clicking on “Submit.” ENTRIES MUST BE RECEIVED BY OR BEFORE 11:59:59 PM ET ON November 9th, 2009.  Limit: One Entry per person. For the purpose of this Sweepstakes, each day will begin at 12:00:01 AM ET and end at 11:59:59 PM ET.  All Entries become the exclusive property of BrandStar Entertainment, LLC (“Sponsor”) and will not be returned.  Sponsor’s clock is the official time clock for the Sweepstakes. 

Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Sponsor is not responsible for lost, late, illegible, incomplete, inaccurate, or mutilated Entries.  Proof of submission does not constitute proof of receipt. If there is a dispute as to the identity of an entrant, the entrant will be deemed the authorized account holder of the email address used to enter. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

• SELECTION OF WINNER:  The winner will be selected within one week of November 9th, 2009 by random computer selection.

Decisions are final and binding on all matters relating to this Sweepstakes and will be posted at www.thebalancingact.com on or before November 9th, 2009.  Winners will also be notified by email, regular mail or by telephone at Sponsor’s discretion, using the contact information provided on the official entry form received.

• The Grand Prize Packages include (for 3 individual winners):  A Dell Inspiron Mini 10”inch Laptop (red in color), and a Garmin Nuvi GPS system (red in color)
• No transfer or substitution of prize is allowed except at the sole discretion of the Sponsor. There is no cash alternative offered, except at the sole discretion of the Sponsor.
• The value of the Grand Prize Package is taxable as income and Winner is solely responsible for all matters relating to the Grand Prize Package, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Grand Prize Package.
• Limit of one prize per person/household for the entire Promotion Period.

• ELIGIBILITY:  Sweepstakes are open only to individual legal residents of the fifty (50) United States and District of Columbia. Officers, directors andemployees and their immediate families and members of the same household of Leisure Time Products, BrandStar Entertainment, LLC, O2 Media Services Group, Inc., and their parents, subsidiaries, affiliates, agents, and advertising and promotion agencies are not eligible to enter or win this Sweepstakes.  Sweepstakes is void outside the United States and where prohibited or restricted.
• VERIFICATION OF WINNER AND DELIVERY OF GRAND PRIZE PACKAGE:   Grand Prize Winner will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release (collectively, “Release”).  (If winner is deemed a minor in his/her state of residence, such winner’s parent or legal guardian will be required to sign Release.)  Release will be sent to winner by overnight delivery.  Prize may be awarded to an alternate winner within a reasonable time if two attempts to make contact are unsuccessful or if the Release is not returned within seven (7 ) days after mailing to winner or if prize notification or prize is returned as undeliverable. Acceptance of the grand prize package constitutes permission for, and winner’s consent (or such winner’s parent or legal guardian’s consent if winner is a minor) to Sponsor and its agencies to use the winner’s name, likeness, photo and/or entry for advertising and promotional purposes without additional compensation, unless prohibited by law.
• GENERAL:  Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.  Florida law, without reference to Florida’s choice of law rules, governs the Sweepstakes and all aspects related thereto.

Sponsor is not responsible for: (a) late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected entries, e-mails or other communications; errors, omissions, interruptions, deletions, (b) defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; data corruption, theft, destruction, unauthorized access to or alteration of entry materials; loss or otherwise; or (c) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant's e-mail account to receive e-mail messages.  Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Sweepstakes and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Sweepstakes if any virus, bug, technical failure, unauthorized human intervention or other cause outside of Sponsor’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes.  In the event of any such cancellation, termination or suspension, a notice will be posted at the Contest Sites and a random drawing will be conducted from among all eligible, non-suspect Entries received as of the termination date. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of her/his Sweepstakes entries) from this Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if she/he tampers with the entry process or if her/his fraud or misconduct affects the integrity of this Sweepstakes.  Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Sweepstakes on in announcement of the prize.  Without limiting the foregoing, Sponsor reserves the right to correct any such error.  By participating in this Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of Sponsor and warrants that she/he is eligible to participate in this Sweepstakes.By participating in this Sweepstakes, winner agrees to hold Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, assigns, directors, employees, and officers harmless from any and all liability, injury, loss or damage caused or claimed to caused by participation in this Sweepstakes and/or acceptance or use of any prize.

• CAUTION.  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
• NAMES OF WINNERS :  To obtain the name(s) of the Grand Prize Package winners, send a self-addressed, stamped envelope to:  BrandStar Entertainment, LLC, 2001 W Sample Rd., Suite 101,Pompano Beach, FL 33064—Put Attention to: BA Navigate Your Career—winners name on the front of the envelope. The name of the winner also will be available at the website www.thebalancingact.com.  Requests must be received by November 9th, 2009.  Requests received after this date will not be honored. Winner’s name will be sent after selection and verification of winner.
